EU Regulation 2019/1157, containing provisions for strengthening the security of ID cards and residency permits issued to EU citizens and their family members, established, at article 8, that from August 3rd 2023 residency permits for a family member of an EU citizens which do not comply with the new requirements, among them the Italian residency permit for a family member of an EU citizen on paper, will cease to be valid. The owner of such permits that have not yet converted their document must apply for a Visa to cross the EU frontiers, if this applies to their nationality.
It is always possible for foreign citizens that applied for an update of their residency permit and which application has not yet been processed, to return to Italy through a direct flight showing the receipt of the renewal of their residency permit.
In all other cases, it will be necessary to apply for a type C Visa “Tourism/EU family member” (90 days with multiple entrances) that will allow foreign citizens to enter Italy and legalize their status. As family member of Italian or EU citizens the Visa will be released freely. It will be necessary to prove your marriage status and that the foreign citizens will accompany or join the Italian citizens.
