We inform all Italian citizens, parents of underage children, that from June 14th 2023 it will no longer be required to present a consent form from the other parent for the issue of your own ID (passport or CIE), according to D.L. 69/2023.
In the new article 3-bis of the Law 1185/1967 it is now stated that, when there is a concrete and current danger that due to a transfer abroad the other parent might escape its obligations toward the children, for the other parent it will be possible to ask an injunction to halt the release of the document.
The application for such a request can be filed to a competent Italian judge at the ordinary Tribunal in which the minor has his/her usual residence or, if the minor is living abroad, the Tribunal in which district is also located the minor AIRE municipality of registration.
For the issue of documents for minors, instead, it is always mandatory a consent signed by both parents or by the person that exercise parental responsibility.
